Britton Chevrolet Employees Indicted for Theft

RICHMOND – Four former employees of the now defunct Britton Chevrolet Olds in Berea were indicted for theft Thursday by a Madison County grand jury.

Darian Jones, Danny Sweet, Don Wilson and Clifford Chambers were indicted for alleged criminal conduct in connection with complaints from customers that began last October.

The indictment states that Jones, Sweet and Wilson were employees of Britton Chevrolet, while Chambers was the dealership’s president.

On counts one through 10, the defendants were charged with accepting vehicles for trade-ins subject to an agreement with customers that Britton would pay off existing loans on those vehicles.

After the customers obtained car financing for the purpose of buying a new vehicles from Britton, and to pay off their existing car loans, the dealership’s agents allegedly deposited the proceeds of said loans into the Britton Chevrolet account, but then made only partial payments to the loan companies holding the liens on the trade-in vehicles. Britton Chevrolet Olds went out of business in January 2009.

In counts 11 through 17, the defendants were indicted for selling used vehicles to customers without revealing that said vehicles had existing bank liens on them. In four of those cases, the liens prevented the customers from obtaining titles to the vehicles they purchased from Britton Chevrolet, according to court documents.

Counts 18 and 19 of the indictment allege that three of the defendants committed theft by failure to make required disposition when, in two separate cases, they failed to transfer the title of vehicles sold, then failed to use proceeds collected from customers to pay the appropriate vehicle use tax to the Madison County Clerk. Jones, Wilson and Chambers were named in count 18, while Wilson and Chambers were named in count 19.

Darian Jones, meanwhile, was named in counts 20 through 22 of the indictments, which allege he committed criminal possession of a forged instrument second degree by possessing three title liens with forged signatures. Jones left the dealership in September of 2008, according to the indictment.

The case came to light last March when the Berea Police Department received complaints from 12 customers who hadn’t received titles or plates because the tax had not been paid in the clerk’s office, or because vehicles still had liens on them.

Darian Jones was indicted for six counts of theft by failure to make required disposition of property, four counts of theft by deception, and three counts of criminal possession of a forged instrument second degree.

Danny Sweet was indicted for seven counts of theft by failure to make required disposition of property and two counts of theft by deception.

Don Wilson was indicted for 12 counts of failure to make required disposition of property, and two counts of theft by deception.

Clifford Chambers was indicted with 12 counts of failure to make required disposition of property, and seven counts of theft by deception.
