Baby uninjured in hit-and-run case
A Madison County man was arrested late Friday for wanton endangerment after police say he was involved in a hit-and-run accident while he was transporting a child.
According to Captain Ken Clark of the Berea Police Department, Josiah S. Hart, 25, was reportedly involved in a traffic accident at the intersection of Chestnut St. and Ellipse St. The accident occurred late Friday and Hart was arrested at approximately 11:14 p.m., Clark said.
Police said Hart initially left the scene, but police caught up with him later.
“When they made contact with Mr. Hart, they detected a strong smell of alcohol beverages on him, and they administered a field sobriety test, which he failed,” Clark said.
Hart was charged with DUI and leaving the scene of an accident, but additional charges of endangering the welfare of a minor and failure to wear a child restraint device were filed.
“He had an old-month child in the car with him, who was not in the child seat nor restrained by a seat belt,” Clark said. “That was sort of a double whammy, because even if the child had been restrained, we still could have charged him with endangering the welfare of a minor because he was driving under the influence.” In addition, Hart was charged with failure to maintain insurance, police said.
Luckily, the child appeared to have been unharmed in the accident.
“There’s nothing on the citation that shows the child was taken to the hospital, so I don’t think the child was injured,” Clark said. “If the child has shown any evidence of injury, the officer would have had an ambulance come and check them out.”
In other police news, a Berea man was arrested after police say he resisted arrest during a traffic stop.
Police say the incident occurred at approximately 10:16 Sunday when Berea police officer William Harris was driving southbound on Interstate 75.
According to Clark, a motorist pulled up behind Harris while his headlights were on the high-beam setting, at which point Harris allowed the motorist to pass, then Harris followed.
The vehicle exited the freeway at Hwy 21 and turned right toward North Dogwood Dr. Clark said Harris reportedly observed the suspect drifting into the on-coming lane three times, at which point Harris activated his emergency lights.
Police said the suspect pulled into the 76 Truck Stop, at which point he jumped out of the vehicle and took off on foot. Harris chased to the Chevron filling station.
Police arrested Mitchell W. Marshall, 29, for DUI, failure to dim headlamps, fleeing and evading police first-degree, driving on a DUI suspended license, resisting arrest, and failure to wear seat belts.
In addition, Marshall was charged with drug related offenses.
“In a plastic baggie in his pocket they found some marijuana, a tablet, which was basically valium, and then in the console of the vehicle, they found two white tablets, which were hydrocordone,” Clark said. “It was just a bad day for him.”
