Richmond Estate Sued After Crash
RICHMOND – A Waco man is suing the estate of a late Richmond resident, claiming damages from injuries he suffered in a auto accident on East Main Street.
According to a complaint filed in Madison County Circuit Court, Happy C. Isaacs, of Waco, is suing Kenneth Gabbard in his capacity as the administrator of the estate of Bill Gabbard.
Bill Gabbard, 88, who resided in Richmond, was involved in a traffic accident. He passed away on May 10.
According to the lawsuit, the accident occurred on May 3, 2009 at the corner of East Main and Orchard Street at approximately 5 p.m. Witnesses at the scene reported that Gabbard failed to yield to a stop sign at Orchard Street and struck the rear driver’s side of a west bound vehicle driven by Jay R. Mitchell, according to police reports. The police report notes that the weather was rainy.
After striking Mitchell’s Hyundai Santa Fe, Gabbard’s Buick Century then spun out of control and into the eastbound lane of East Main, where it was struck by a Chevy truck driven by Happy C. Isaacs. Isaacs told police he did not have time to stop before striking Gabbard’s vehicle on the driver’s side, police reports stated. Police reported that Unit 1, driven by Bill Gabbard, struck Unit 2, driven by Jay Mitchell. The collision sent Gabbard into the path of Unit 3, driven by Happy C. Isaacs.
Police said Gabbard was not wearing a seat belt at the time of the accident, and he had to be extracted from the wreck by the Madison County Fire Department before he was transported to Pattie A. Clay Medical Center with multiple injuries. Happy C. Issacs and his passenger, Lelia Isaacs, were also transported to Pattie A. Clay after reporting back pain as a result of the accident.
Mitchell, meanwhile, refused treatment, the police report stated.
Isaacs is suing the estate of Bill Gabbard, claiming Gabbard’s alleged negligence on the road resulted in Isaacs suffering permanent injuries that will impair his ability to earn money in the future, and caused him to suffer mental anguish and incur medical expenses.
Gabbard’s vehicle suffered very severe damage, while Isaac’s vehicle suffered moderate to severe damage, according to the report by the Richmond Police Department.
Isaacs is represented by Gary C. Johnson, P.S.C. of Lexington.
